Damage to our Vehicles
As per the Car Club’s Terms and Conditions, members are financially responsible for any damage that occurs to our vehicles during their rental period. This includes any damage sustained by a vehicle that is not necessarily the fault of the member renting the vehicle at the time the damage is sustained.
In circumstances where damage is sustained by our vehicles that is not the fault of the member who is in possession of a vehicle at the time any damage occurs, the member is responsible for recouping the cost of that damage from any at-fault third party. In such circumstances the Car Club will assist the member by providing any information held by the Car Club to assist the member with reclaiming costs.
An example of such a situation would be if one of our vehicles were to sustain damage from a carriageway defect (e.g. a pothole) whilst it is being used by a member. This includes situations where the damage manifests itself during the member’s usage period but also situations where the damage is discovered after a member has used a vehicle.
In such circumstances the member is responsible for arranging and paying for a replacement tyre/wheel/etc. in the same way in which they would as if damage had been sustained by a vehicle owned by the member. In such circumstances should the member wish to collect evidence and submit a claim against the relevant highway authority in respect of the damage sustained by the vehicle in order to recoup that cost the Car Club will provide the member with any relevant information it holds to assist them with making such a claim. However, the collection of evidence, preparation and submission of any such claim is the sole responsibility of the member.
